probate

Lei Dat & Baig Solicitors agree a fixed price without any extras, unless the estate is particularly complex. You don’t have to worry about hourly rates or percentages of the value of the estate with Purely Probate. We will ask you a number of questions, then give you a quote.

If there is no Will, we will tell you who is entitled to the assets of the person who has died. This is known as an intestate estate.

Obtaining probate is the process of transferring the assets of the person who has died to their Executors (if there is a Will) or Administrators (if there is no Will). It includes applying to the Court and submitting a tax declaration to HM Revenue & Customs.

We will transfer the assets of the estate to the Executors or Administrators. We will prepare the Estate Accounts, agree them with you, and arrange for payments of the correct amounts of tax with the remainder paid to the beneficiaries.

Our team is committed to providing you with clear and efficient support during what can often be a difficult and complex time. Your case will be dealt with by a qualified Solicitor who may be assisted by an experienced caseworker or paralegal. Our fees are structured as follows:

1. Grant of Probate Application:

  • Fixed Fee: £750 plus VAT
  • Probate Fee: £160 (subject to change based on government fee alterations) This service involves attending to the client, preparing the application for the Grant of Probate, and liaising with the Probate Registry. We will ensure all required documentation is in order to secure the Grant of Probate. The process typically takes around 2-3 weeks.
  • The fee for applying for a grant of probate or a grant of letters of administration is £300 and the fee for each extra copy of the grant is £1.50 per copy.

If following the issue of the Grant of Probate or Letters of Administration work is required in connection with the administration of the estate and the collecting in of the assets of the estate there may be disbursements payable in connection with that work. An example of the disbursements would be fees for transferring monies which would be £30, there may also be disbursements in connection with the sale of property such as estate agencies, fees payable in connection with the sale of leasehold property.

Furthermore if there was to be a transfer of property within the estate then there may be fees payable to the land registry the registration of the title of any beneficiary. If it is necessary to sell shares there may be charges payable to the particular share registrar who deals with the sale. Our policy would be that any disbursements of which we are aware at the time of the issue of our client care letter and terms of engagement will be contained and notified to the client within our client care letter and terms of engagement. Thereafter any disbursements of which we become aware during the administration of the estate will be notified to the client immediately we become aware of the same

2. Estate Administration:

Fee: 1.5% of the value of the estate, or £1,500 plus VAT, whichever is greater Estate administration includes gathering and valuing the deceased’s assets, paying off
debts and liabilities, and distributing the estate to the rightful beneficiaries. This process typically takes around 3-4 months, depending on the Probate Registry’s
processing times and the complexity of the estate.

3. Full Estate Administration (Including Complex Matters):

For larger or more complex estates, such as those with multiple beneficiaries, extensive property holdings, or unresolved legal matters, we estimate a timeframe of 4-6 months to complete the administration from start to finish. We will work closely with all parties involved to ensure that every aspect of the estate is handled properly and in accordance with the law.

4. Sale or Transfer of Shares or Other Assets:

If the estate involves shares, investments, or other assets that need to be sold or transferred,an additional fee will apply. This fee will depend on the value and complexity of the shares or assets involved. We can also assist with the sale of property if needed.

5. Inheritance Tax (IHT):

If the estate is liable for inheritance tax, we can provide advice on the calculation and payment of this tax. It is important to ensure that any IHT returns are filed within the required time frame to avoid penalties. The value of the estate and the available exemptions will determine whether inheritance tax is payable.

6. Contested Wills or Disputes:

In the unfortunate event that the estate becomes subject to disputes, such as contested wills or disagreements among beneficiaries, we can assist with resolving these matters, either through negotiation or legal proceedings if necessary.

7. Intestate Estates (No Will):

In cases where there is no valid will (intestate estates), we can guide you through the process of distributing the estate according to the rules of intestacy. This can be more complex, as it may involve identifying rightful heirs, especially if the family situation is complicated.
